अनुदेशिका का ब्लॉक स्तरीय स्थानांतरण करें - हाईकोर्ट

 

प्रयागराज : इलाहाबाद हाईकोर्ट ने जिला बेसिक शिक्षा अधिकारी बस्ती को निर्देश दिया है कि छह दिसंबर 2019 के शासनादेश के तहत अनुदेशिका का ब्लॉक स्तरीय स्थानांतरण का आदेश करें। कोर्ट ने कहा कि पहली जुलाई 2022 से याची को पूर्व माध्यमिक विद्यालय बीजलपुर ब्लॉक रुदौली, बस्ती से अपर प्राइमरी स्कूल सहिजनपुर, कप्तानगंज स्थानांतरित कर दिया जाए।

यह आदेश न्यायमूर्ति सिद्धार्थ ने शारदा राव की याचिका स्वीकार करते हुए दिया है। अधिवक्ता दुर्गा तिवारी के अनुसार याची ने शासनादेश के तहत 16 दिसंबर 2019 को बीएसए को स्थानांतरण की अर्जी दी है लेकिन उस पर कोई आदेश नहीं किया गया है। इस पर यह याचिका कर स्थानांतरण का समादेश जारी करने की मांग की गई थी। 

विपक्षी की ओर से जवाबी हलफनामे में कहा गया कि पूर्व माध्यमिक विद्यालय में 100 से कम छात्र हैं। ऐसे में स्थानांतरण नहीं किया जा सकता। याची के अधिवक्ता का कहना था कि खंड शिक्षा अधिकारी की रिपोर्ट में छात्र संख्या 102 बताई गई है। कोर्ट ने कहा कि इसका उत्तर जवाबी हलफनामे में नहीं दिया गया है। इस पर कोर्ट ने बीएसए बस्ती को याची का स्थानांतरण करने का निर्देश दिया है।

Counter affidavit has been filed by learned counsel for respondent no.4, which is taken on record.

This writ petition has been filed praying for direction to respondent no.4, District Basic Education Officer, Basti, to transfer the petitioner to Uppar Primary School, Sahijanpur Vikas Khand Kaptanganj, District Basti in pursuance of the Government Order dated 06.12.2019 and the application dated 16.12.2019 submitted by the petitioner.

The grievance of the petitioner is that she wants transfer to Uppar Primary School, Sahijanpur Vikas Khand Kaptanganj, District Basti from Purva Madhyamik Vidhyalaya, Bizalpur Vikas Khand Rudhauli, District Basti in pursuance of Government order dated 06.12.2019. She has already made an representation dated 16.12.2019 in this regard before the respondent no.4, District Basic Education Officer, Basti, but no order has been passed on her representation. Hence she is before this Court.

A counter affidavit has been filed by respondent no.4, wherein it has been stated that there are less than 100 students in Purva Madhyamik Vidhyalaya, Sahijanpur, Vikas Khan Kanptanganj, District Basti. Therefore, petitioner has not been transferred to the aforesaid institution.

Learned counsel for the petitioner has pointed out to the certificate of Block Education Officer, Kantanganj, Basti, stating that in Purva Madhyamik Vidhyalaya, Sahijanpur, Vikas Khan Kanptanganj, District Basti, the number of students is 102. No reply is given to the certificate of Block Education Officer in the counter affidavit.

A direction is issued to respondent no.4, District Basic Education Officer, Basti, to transfer the petitioner to Uppar Primary School, Sahijanpur Vikas Khand Kaptanganj, District Basti� from Purva Madhyamik Vidhyalaya, Bizalpur Vikas Khand Rudhauli, District Basti,� in pursuance of the Government Order dated 06.12.2019, next session commencing from 1st July, 2022.

This writ petition is allowed.
